Public Liability

A general Public Liability policy protects an insured in respect of his legal liability to third parties; for both bodily injury (which includes death, illness or disease), and for any loss of or damage to property...

which happens in connection to the business insured under the policy and occurs during the period of the policy. Some policy wordings may also include a reference to interference with a right of way or may specifically extend to nuisance, obstruction, loss of amenities, trespass or the like. Some policies may also specifically cover such risks as wrongful arrest, invasion of the right of privacy, detention, wrongful imprisonment or wrongful eviction of any person. The indemnity relates to only legal liability; there must be an accident or event which results in injury, illness, loss or damage, and which places a liability on the insured. Legal liability refers to all forms of liability e.g. negligence, nuisance, trespass, strict liability, liability under statute or contract, and vicarious liability.

The policy provides an indemnity to the insured: ‘against liability at law for damages and claimant’s costs and expenses in respect of bodily injury or disease sustained by an employee, while employed in or temporarily outside the Republic of Ireland, caused during the Period of Insurance and arising out of and in the course of his employment by the insured in the business’.
